**Q: Is an agency agreement the same as an employment contract?**
No. An agency agreement appoints an independent party to represent you; an employment contract creates an employment relationship with the obligations that carries. If the person is genuinely working under your direction and control, employment status may apply regardless of what the document is called — take advice if you are unsure which one you need.

**Q: How is commission usually handled in this template?**
The template provides for commission as a percentage of the sale value, with the rate, the calculation basis and the payment timing left as placeholders for you to complete. It also covers what happens when an order is later cancelled or refunded.

**Q: Can I make the appointment exclusive?**
Yes — the territory clause is written so you can state whether the agent is the only party appointed for that territory or whether you may appoint others. Decide this deliberately, because exclusivity is one of the terms agents most often want changed later.
